The documents provided as templates and are intended to act as base and guide for your own agreement making with a subject/client. The documents may not take into account every particular engagement encountered with a subject/client. PPAQ recommend that PPAQ members seek their own independent legal advice in relation to any particular questions or concerns they have about any agreement or engagement they enter with a subject/client. PPAQ accepts no liability for any arrangement that PPAQ members may enter using or relying on the template agreements.
Services agreement
The services agreement can be used when there is a direct engagement between the photographer and a subject/client, for the provision of photography and/or videography services. The client is not necessarily the subject of the works produced.
The template includes various options for a photographer to select or delete. The template is intended to address a range of circumstances relating to deposits, number of photographs and intellectual property. Photographs taken under the agreement are protected by copyright. Unless the parties otherwise agree, an individual subject/client has no copyright interest in photographs taken of them.
Releases
The model release templates can be used whether or not there has been a direct engagement between the subject and the photographer. They should be used when a photographer will take photographs of a person or persons, either alone or in group shots.
The purpose of the model release templates is to ensure that both parties understand their rights and obligations in respect of the photographs. Ideally, the model release will be entered into before photographs are taken.
The location release should be used in circumstances where the photographer is not the owner or occupier of a premises at which the photographs are taken. This applies to the access of private property, rather than the use of public spaces. This document should be entered into between the photographer and the owner/occupier, in satisfaction of the owner/occupier’s permission for entry to the property or land.
